ID360 Terms and Conditions

You must sign this form to be eligible to enter ID360 Short Film Competition.

drawing. 1. The Producer by completing this entry form and delivering it to the Ministry of Youth Development by 29 February 2008 has entered into the ID360 Short Film Competition and accepts the following conditions.

2. The Ministry of Youth Development may, in absolute discretion and, without giving reasons, select short films for the judging round for the finalists for viewing on the Ministry of Youth Development website. Any prizes awarded are not transferable, replaceable and are subject to the relevant income tax.

3. Producer Guarantee
The Producer makes the following guarantees to the Ministry of Youth Development:
a) the Film was made by the Producer specifically for ID360;
b) the actors in the Film have consented in writing to the use of their performances in the Film;
c) the Producer is the owner, or has the permission of the owner, of the copyright in the sound recordings comprising the soundtrack to the Film and the works (ie lyrics and music) reproduced in those sound recordings;
d) the Producer has obtained from each contributor to the Film, authorisation for the Ministry of Youth Development to use the contributor’s name and likeness in connection with any publicity for ID360.
e) the Producer has obtained from each contributor to the Film a written consent to their work being edited, altered and/or reproduced, in any manner or context, by the producer and any person authorised by the producer to do so and such consents have been obtained to the full extent permitted under the Copyright Act, 1994 (Moral Rights Consents);
f) the producer will pay all fees and other charges related to entry of the movie in ID360;
g) All details in this entry form are true and correct;
h) The producer indemnifies the Ministry of Youth Development against any and all claims made against the Ministry of Youth Development in relation to the guarantees provided by the Producer in clause 3 of this entry form;

4. Limitation of Liability
The Ministry of Youth Development reserves the right to cancel, terminate, modify or suspend the Contest and to disqualify any individual who tampers with the Contest. The Ministry of Youth Development assumes no responsibility for any of the submitted Films. The Ministry of Youth Development is not responsible for any damage or loss caused by participating in the ID360 competition or by downloading any materials of ID360.

5. Grant Rights in Films Submitted
The Producer by submitting a short film has assigned a irrevocable non-exclusive right to the Ministry of Youth Development. This right will consist of a right to use, copy, sublicense, edit, modify, make derivative works, publish, transmit, distribute, publicly perform, publish, delete or display the content of and elements embodied in the video and the video itself, in whole or in part, in perpetuity in any and all media.

6. The agreement is governed by the laws of New Zealand.

7. I, the producer (name), …………….. understand and agree to the terms and conditions of entry as outlined above and certify that I am entitled to enter in my chosen category and prepared to produce such evidence if required. I also certify that I am of a legal age to undertake this agreement.
